TERMS OF USE

These Terms of Use apply to NewNeighborsPartnership.org, subdomains, and any other New Neighbors Partnership (NNP) sites, applications, or services; or any features of these sites, applications, or services. By accessing or using this website, you signify that you have read, understand, and agree to be bound by the terms of this policy whether or not you are a registered user of NNP. If at any time you do not agree to abide by these or any future terms, do not use or access this website. NNP reserves the right to change this and any other policy on the NNP website at any time, without any notice to you, by posting updated Terms of Use and/or an updated Privacy Policy. Any modifications, additions, or deletions to these Terms of Use or the Privacy Policy shall be effective immediately upon posting. Your continued use of the NNP website following the posting of updated Terms of Use or an updated Privacy Policy will mean that you agree to those changes.

PERSONAL INFORMATION

NNP collects personal information from users, including, but not limited to, an individual’s name, address, telephone number, credit card information, or email address, in association with donations, user registration, newsletters, and other activities, when relevant. Additionally, when a user visits the NNP website some information is automatically collected, including, but not limited to, the user’s computer operating system and browser type, version, and capabilities. NNP also uses personal information to communicate with registered users. For example, NNP might use your personal information to send you newsletters or to solicit funds.

NNP does not sell or rent personal information to third parties. Occasionally, NNP does share personal information with similar nonprofit organizations. We are committed to the privacy of our donors. Should you prefer that we not share your information with other nonprofits, you may opt out at any time by emailing NewNeighborsPartnership@gmail.com

PROPRIETARY RIGHTS OF NNP; WEBSITE CONTENT

All content on the NNP website including marks, logos, text, pictures, video, audio, and other materials, and their selection, arrangement, and compilation (“Content”) are the property of NNP. Content of the NNP website cannot be downloaded, modified, copied, distributed, displayed, or transmitted other than for your personal non-commercial use without the express, written consent of NNP. Other than User Materials you have submitted to NNP, you are granted a limited license to download or print a portion of NNP Website Content for your own personal, non-commercial use only, provided that: (a) you include without modification all copyright and other proprietary notices contained in the content; (b) you do not modify the content; (c) you do not use the content in a manner that suggests NNP promotes or endorses your, or any third party's, causes, ideas, websites, products, or services; and (d) you do not use the content in any way that is unlawful or harmful to any other person or entity. This license is revocable at any time without notice or cause.

Any other use of Content requires express prior written permission from NNP.

USER MATERIALS

Throughout the NNP website and its related subdomains and sites, including, but not limited to NNP’s Facebook Application and the Contact Us page, users may post, upload, transmit and/or otherwise submit comments, messages, other text, photos, images, stories, essays, videos, audio files, and other content and materials (“User Materials”). You acknowledge that User Materials may be routed through our servers, the servers of one or more third parties on our behalf, and the Internet, and may be viewed by NNP staff and by the general public.

We reserve the right to screen, refuse to post, remove, or edit User Materials at any time and for any or no reason in our absolute and sole discretion without prior notice, although we have no duty to do so. If we elect to screen User Materials, there may be a delay in the posting of such content to allow for a review process. If we have questions about your User Materials, we have the right, but not the duty, to contact you for further information, including, for example, to verify that you own the copyright or otherwise have the rights to post the User Materials.

You retain the copyright and other ownership rights in any User Materials that you submit on or through the NNP website. However, by submitting User Materials on or through the NNP website, you hereby grant NNP a non-exclusive, perpetual, royalty-free, worldwide, transferable license to use, copy, sublicense, modify, transmit, publicly perform, display, create derivative works of, host, index, cache, tag, encode, and/or adapt your User Materials in any and all media formats or channels, whether now known or hereafter devised, including, but not limited to: the NNP website, applications, and services; third party licensee websites, applications, and services; over the air (on radio or television); and other applications and services; without payment and without further consent or notice to you. You further grant NNP the right to contact you in connection with your User Materials and to use your name, city, state, and other information that you have provided in connection with the User Materials.

RULES FOR USE OF THE WEBSITE

By using the NNP website, including by registering for the NNP website, participating in online discussions, submitting User Materials, viewing or accessing information from any pages on the NNP website, or by using any other features of the NNP website, you agree to the following rules:

  1. You may not submit any User Materials anonymously or under a false name or a false email address. You may not impersonate another user or provide any false information about yourself.

  2. You may not submit any User Materials or links to material that is libelous, defamatory, false, obscene, indecent, lewd, pornographic, violent, abusive, threatening, harassing, discriminatory, in violation of the law, harmful to children, in violation of third party privacy rights, or that constitutes hate speech or a personal attack.

  3. You may only submit User Materials for which you have the copyright or other necessary rights and permission to distribute electronically. You may not violate, plagiarize, or infringe on the rights of third parties, including copyright, patent, trademark, trade secret, privacy, personal, publicity, moral, or proprietary rights. You promise and represent that you own or have all necessary rights and permissions to use, distribute, and authorize NNP, and users of the NNP website (to the extent permitted by these Terms of Use), to use and distribute any User Materials.

  4. The NNP website can only be used for personal, non-commercial purposes. You cannot submit any material containing any solicitation of funds, advertising, promotion, solicitation for goods and services, or recruiting.

  5. You may not submit any software or other material which contains a virus, worm, Trojan horse, or other harmful computer code, files, scripts, agents, programs, or device. You may not use the NNP website to distribute chain letters, mass mailings, "spam," or duplicative or unsolicited messages in violation of applicable laws, or to gather usernames and/or email addresses for the purpose of sending unsolicited email or other communications to other users of the NNP website.

  6. You may not interfere with or disrupt the integrity or performance of the NNP website, any portion or contents thereof, or related systems or networks, or use the NNP website in any way which degrades its reliability, speed or operation, or its underlying hardware or software. In addition, you may not attempt to gain unauthorized access to the NNP website or related systems or networks.

  7. By submitting any User Materials on or through the NNP website, you hereby grant NNP, and users of the NNP website, applications, and services (to the extent permitted by the Terms of Use), the licenses to use those User Materials as set forth above in the "User Materials" section.

  8. You are solely responsible for any User Materials submitted using your account. NNP does not and cannot review all User Materials submitted by you or others and is not responsible for any User Materials submitted by you or others on or through the NNP website. However, NNP has the right (but not the obligation) to review, screen, delete, edit, and/or move any User Materials that it deems, in its sole discretion, to be in violation of the Rules for Use of the website or these Terms of Use, or for any other reason, as determined in NNP’s sole discretion.

  9. NNP is not responsible or liable for any User Materials submitted by you or a third party on or through the NNP website. NNP cannot verify the accuracy of statements that users make or place on or through the NNP website, and does not guarantee that any User Materials have been submitted with the permission of the copyright or proprietary owner or are otherwise in compliance with the Rules for Use of the website or these Terms of Use.

  10. If you access the NNP website from a location outside the United States, you are responsible for compliance with applicable laws, including local laws regarding online conduct and content and U.S. export laws and regulations.

  11. By using the NNP website, you agree to abide by these rules. You acknowledge that NNP has the right (but not the obligation) to review, screen, delete, edit, or move content or material that it deems, in its sole discretion, to be in violation of the Rules for Use of the website or these Terms of Use, or for any other reason, in its sole discretion. You further acknowledge that NNP has the right to limit or terminate your, or any other person's, access to or registration in the NNP website for any reason, in its sole discretion, including violation of the Rules for Use of the website or these Terms of Use.

NNP PROVIDED CONTENT

NNP uses reasonable efforts to ensure the accuracy and correctness of NNP provided content, but NNP makes no representations or warranties as to this NNP provided content.

LINKS TO OTHER WEBSITES

The NNP website might provide links or references to other non-NNP websites and resources. NNP is not responsible, and makes no representations, warranties, or commitments, nor does NNP accept any liability whatsoever, for the policies, practices, or content of these websites. A link to a non-NNP website does not mean that NNP endorses the content or use of such website or owner. In addition, NNP is not a party to, nor responsible for, any transactions you may enter into with third parties, even if you learn of such parties (or use a link to such parties) from the NNP website.

RELEASE AND INDEMNITY

YOU HEREBY RELEASE AND WAIVE ANY AND ALL CLAIMS AND/OR LIABILITY AGAINST NEW NEIGHBORS PARTNERSHIP ASSOCIATION ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE NNP WEBSITE. YOU ALSO AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS NNP FROM AND AGAINST ANY AND ALL CLAIMS OR LIABILITY, INCLUDING COSTS AND ATTORNEYS FEES, ARISING FROM OR IN CONNECTION WITH YOUR USE OF THIS WEBSITE OR FAILURE TO ABIDE BY APPLICABLE LAW.

CHOICE OF LAW

The state and federal courts of the state of New York are the exclusive forum and venue to resolve any and all disputes arising out of use of the NNP website. Users of the NNP website consent to personal jurisdiction and venue by the state and federal courts of the state of New York. Furthermore, the laws of the state of New York govern any disputes arising from use of the NNP website.

PRIVACY POLICY

New Neighbors Partnership (NNP) is committed to protecting your privacy and developing technology giving you the most powerful and safe online experience. This Privacy Policy applies to NNP’s website and governs data collection and usage. By using the NNP website, you consent to the data practices described in this Privacy Policy. 

Collection and Use of Your Personal Information

NNP collects personally identifiable information from users, such as an individual’s name, e-mail address, home or work address, telephone number or credit card information, known as “PII.” NNP collects PII in association with donations, user registration, newsletters and other activities, when relevant.

NNP collects information about its private donors and amounts raised by donors. When a private donor wishes to donate through NNP’s website, the donor must register its information there. A donor will provide information such as name, company name, e-mail address, home or work address, phone number, credit card number and other relevant data. This information is used by NNP to identify the donor, provide the donor with mailings and communications and process the donor’s billing information.

NNP also uses personal information to communicate with registered users. For example, NNP may use your personal information to send you our newsletter or to solicit funds, or NNP may collect and process any personal information you volunteer to us in our website’s forms, such as when you register for events or sign up for information and newsletters.

There is also information about your computer hardware and software automatically collected by NNP. This information can include your IP address, browser type, domain names, access times and referring website addresses. This information is used by NNP for the operation of NNP services and website, to maintain the quality of the NNP website and to provide general statistics regarding use of NNP’s website.

Please keep in mind that if you directly disclose PII or personally sensitive data through NNP public message boards, this information may be collected and used by others. NNP encourages you to review the privacy statements of websites you choose to link to from NNP so that you can understand how those websites collect, use and share your information. NNP is not responsible for the privacy statements or content of any other website other than the NNP website.

Protecting Confidentiality

Any information stored on NNP’s digital platforms is treated as confidential. We restrict access to personal information collected about users to our employees or others who need to know information to provide services to you or in the course of conducting our business operations. NNP binds all of its employees to its Confidentiality Policy.

NNP does not sell, rent or lease its website user or online and offline donor information or PII to third parties, except where NNP may share data with trusted partners and nonprofit organizations to help us perform statistical analysis, send email or postal mail, provide user or technical support, or reach out to new prospective supporters. All such third parties are prohibited from using your PII, except to provide these services to NNP, and they are required to maintain the confidentiality of your information, including your name, email address, physical address, and phone number.  Website users and online or offline donors may opt out of having their email, phone, or postal information sold, rented, or leased at any time by contacting NewNeighborsPartnership@gmail.com and requesting that their names and contact information be removed from any lists that NNP shares, exchanges, or rents.

 

NNP does not use or disclose your sensitive personal information, such as race, religion, medical information or political affiliation, without your explicit consent.

 

NNP keeps track of the links and pages our users visit within NNP, in order to determine which website features or pages are the most popular. We send targeted social media posts to users based on user analytics and user activity.  NNP uses information about donations, actions taken or users’ content preferences to generate custom email solicitations for donations.

 

NNP will disclose your personal information, without notice, only if required to do so by law or in the good faith belief  such action is necessary to: (a) conform to the requirements of the law or comply with legal process served on NNP or the site; (b) protect and defend the rights or property of NNP; and (c) act under certain circumstances to protect the personal safety of users of NNP, or of members of the public.

Use of Cookies

The NNP website use "cookies" to help you personalize your online experience. A cookie is a text file that is placed on your electronic system’s  hard drive, operating system or mobile device by a webpage server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

For example, if you sign up to donate or volunteer through NNP’s website, a cookie helps NNP recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses and so on. When you return to the same NNP website, the information you previously provided can be retrieved.

 

You have the right to accept or decline our use of such cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. Security of Your Personal Information

NNP maintains appropriate physical, electronic and procedural safeguards to secure your personal information from unauthorized access, use or disclosure. NNP secures the PII you provide on the NNP website in a controlled, secure environment, protected from unauthorized access, use or disclosure. When personal information (such as a credit card number) is transmitted to other websites, such as a third party payment processor, such information is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol. We also advise all NNP employees about their responsibility to protect customer data and we provide them with appropriate guidelines for adhering to our company's business ethics standards and confidentiality policies.  Data collected is stored in password-controlled servers with limited access.

Your Right to “Opt-Out”

NNP operates a strict “opt-out” policy for individuals. This means we will not send you any information unless you have requested to receive e-mail/text/social media message updates from us. If you are a private donor or NNP email list subscriber and you receive emails from us, you may unsubscribe or update your email preferences at any time by following the instructions contained within the email or by sending an email to our Data Protection Officer as indicated below. Donors and NNP listserv subscribers are able to view and modify settings relating to the nature and frequency of promotional communications that they receive from us by accessing NNP’s website.  For businesses, NNP will continue to contact businesses with news and information until we are informed that this communication is no longer required.

Changes to this Policy

NNP will occasionally update this Privacy Policy to reflect company and user feedback. NNP encourages you to periodically review this Privacy Policy to be informed of how NNP is protecting your information.
